GENERAL TERMS OF SALE

1. Acceptance of the general conditions of sale and conclusion of the contract

1.1 The contract concluded between Lomaestro and Sons Ltd. and the Customer shall be deemed concluded with the acceptance of the order by Lomaestro and Sons Ltd. In case of non-acceptance of the order, Lomaestro and Sons Ltd. will promptly notify the Customer.

1.2 By placing an order in the various ways provided, according to the order form on the Site, the Customer declares that he has read all the information provided to him during the purchase process and fully accept these general conditions, indicated in accordance with the provisions of art. 12 of Legislative Decree no. 70/2003 and art. 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014

2.Method of purchase

2.1 For the purposes of completing the order, the customer must fill out in its entirety the relevant form on the Site and submit it after viewing the Conditions, as well as the characteristics of the product and/or products he intends to purchase. The Customer must also request to Lomaestro e Figli srl, if it wishes, the issuance of a tax invoice relating to the purchase, pursuant to art. 22 D.P.R. n. 633/1972 by filling in the appropriate fields.

2.2 The correct receipt of the Order is confirmed by Lomaestro e Figli srl by an e-mail reply, sent to the e-mail address provided by the Customer. This confirmation message will summarize the conditions of purchase and the data entered in the order by the Customer, so that the latter can verify them and, if necessary, communicate without delay the corrections of any errors.

3.Prices and Method of Payment

3.1 The prices shown on the site are to be considered inclusive of taxes and VAT. Any shipping costs or payment charges are in any case calculated in the shopping cart once the items are entered.

3.2 The following payment methods are provided:

3.2.1 PAYMENTS BY CARD

The customer may choose to pay for the order by credit card or debit card. The accepted credit cards are: VISA, MASTERCARD, AMEX, Union Pay. We also accept payment by POSTEPAY and all rechargeable cards operating within the VISA circuit.

3.2.2 BANK

TRANSFER The customer may choose to pay what he/she has purchased by bank transfer by entering the following IBAN: IT18D0526215700CC0091347983 payable to Lomaestro e Figli srl. In the reason for payment enter the order reference number confirmed in the email.

3.2.3. PAYPAL PAYMENTS WITH PAY BY RATE OPTION

Paypal is an absolutely secure online payment method that allows the customer to pay for the order by accessing his account directly, through confirmation of payment. Account and credit card details linked to your account are handled directly by Paypal, which will provide an email notification, following payment. Lomaestro and Sons Ltd. does not have, in any way, the ability to access the data of the cards with which customers make payments. To meet the needs of all customers Paypal offers the possibility to pay in 3 convenient installments, without interest and without management costs for amounts from € 30.00 to € 2,000.00. Viewing and managing the due date of installments is possible by consulting the PayPal app in the section ''Show upcoming payments'': this also allows prepayment at the will of the buyer, at no additional cost. Even with installment payments, PayPal protects all purchases in case the item does not arrive or does not match the description. Choosing installment payment is very simple: it will be enough to select Paypal as the payment method; if available, the option ''pay in 3 installments'' will appear; after receiving confirmation by sending a code to their cell phone, the customer will be able to complete the purchase.

3.3.4. COD

Payment must be made at the time of delivery of the purchased products. The payment by cash on delivery involves an additional charge of € 4.50 to be borne by the Customer for collection costs.

4.Delivery of products and related expenses

4.1 All orders will be processed and shipped to the address indicated by the customer in the order; Lomaestro e Figli srl uses couriers such as Poste Italiane, GLS and Bartolini and will dispatch all orders within 24-48 working hours at the cost, if any, indicated in the cart before sending the order. Any delays in shipment will be promptly communicated to the customer. Lomaestro and Sons Ltd. reserves the right to choose the courier for the shipment of orders, unless exceptions indicated at the request of the customer. In addition, Lomaestro e Figli srl reserves the right to accept requests outside the borders of Italy, for which not only shipping costs, but also delivery times, would vary.

4.2 Delivery times indicated by Lomaestro e Figli srl are to be considered purely indicative and any delays caused by the couriers of the destination branch are not to be attributed to the sender.

4.3 The pictures relating to the category of the fittings (in particular, the colors) are indicative; therefore, different colors from those in the picture are not to be considered as a defect or error and are not attributable to the sender in terms of return.

4.4 Upon delivery of the products, the Customer is required to check that the number of packages being delivered corresponds to what is indicated on the waybill affixed to the package and that the packaging is intact, undamaged or altered, including in the sealing materials (adhesive tape or plastic straps). Any damage to the packaging and / or the product or the mismatch in the number of packages or indications, must be immediately detected by contacting No. 0885787275 or writing on WhatsApp at 3791053278. Any problems with the physical integrity, correspondence or completeness of the products received must be reported within 3 days after delivery, in the manner provided herein.

5.Right of withdrawal

5.1 The Customer, as reported in Article 52 of Legislative Decree 206/2005, later amended by Legislative Decree 21/2014, may withdraw from the purchase contract for any reason, without the need to give reasons and without penalty, within 14 (fourteen) working days from the date of receipt of the products

5.2 To exercise the right of withdrawal, the customer must send to Lomaestro e Figli srl a communication within the terms indicated to the email address tecnologiaacqua@gmail.com.

5.3 In case of withdrawal, the Customer may send, at its own expense, the products to Lomaestro e Figli srl within 14 (fourteen) days of withdrawal itself, to the following address: Lomaestro e Figli srl, Contrada Valle Scodella SNC, Ordona (FG) 71040. Alternatively, you can ask customer service, after fixing the day, for pickup by one of our couriers. For the withdrawal there will be a transfer of € 8.00 from the amount paid by the customer. The goods must be returned undamaged, complete with all its parts and in the original packaging. Lomaestro and Sons Ltd. does not allow partial returns, so the right of withdrawal may apply to the product purchased in its entirety. In case of damage to the goods during transport, Lomaestro e Figli srl will notify the customer, so that he can file a timely complaint against the carrier of his choice and obtain a refund; in these cases the product will be returned to the customer, against whom the request for withdrawal will be canceled. Lomaestro e Figli srl will not respond in case of damage, theft, loss occurred during shipment for return.

5.4 Lomaestro and Sons Ltd. will refund the customer the full amount already paid within 14 (fourteen) days after the withdrawal only after the item is returned to the premises through the procedure of reversal of the amount charged, using the same means of payment used by the Customer for the initial transaction, unless otherwise agreed. In any case, the Customer will not incur any costs as a consequence of said refund.

5.5 In any case, the customer will forfeit the right of withdrawal in cases where Lomaestro e Figli srl ascertains that:

- the returned product is not intact;

- the product is missing its outer packaging and/or original inner packaging;

In the case of forfeiture of the right of withdrawal, Lomaestro e Figli srl will return the purchased product to the sender, charging the sender the shipping costs and the price of the product.

6. Warranties

Lomaestro e Figli srl will arrange for the product to be picked up by sending one of its couriers and, once returned, the item will undergo checks and inspections by the technical department. The timeline for the inspection could take up to 10 working days; if the technical department determines that the product is defective, Lomaestro e Figli srl will ship a new item without charging any shipping costs to the customer. If the extraneousness of the factory defect is ascertained, shown to the customer through photos and explanatory videos, the customer will be charged not only the costs of the withdrawal, but also of the new shipment of the purchased object. In case of a factory defect detected after the 30 days, the customer may contact customer service and expose the problem also by sending photos and explanatory videos; Lomaestro e Figli srl will arrange the withdrawal of the product by sending one of its courier and, if it detects the defectiveness of the product will reserve the right to propose to the customer the various alternatives (repair of the product, refund, etc.).

6.2 The warranty for conformity defects will apply as long as the relevant product has been used correctly, in compliance with its intended use and as provided in the instructions.

6.3 In the event that, for any reason, Lomaestro e Figli srl is unable to return to the Customer a product under warranty (repaired or replaced), or, in the event that the repair or replacement is excessively onerous, Lomaestro e Figli srl may proceed with the termination of the contract by payment of the amount paid (refund).

6.4 In cases where the application of the guarantees provides for the return of the product, the same will be returned by the Customer in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment).
